Notice of Outcome for Gross Misconduct Hearing held in public on 18-20 May 2021

PS Timothy Brown of AW BCU.

It was alleged that PS Brown breached the standards of professional behaviour in respect of Authority, Respect and Courtesy, Equality and Diversity and Discreditable Conduct.

Allegation 1 alleged that PS Brown shared an inappropriate article on his Facebook page which made reference to sexual activity in the workplace. 

Allegation 2 alleged that in the presence of junior officers PS Brown undermined a woman Sergeant on the team by using vulgar language to refer to her and her ability to do her job and that this was discriminatory against her as a woman. 

Allegation 3 alleged that PS Brown referred to a member of the public in a sexual manner and

Allegation 4 alleged that PS Brown made a derogatory remark about a transgender woman and that this was discriminatory on the basis of her transgender status.

It was alleged that these matters amounted to Gross Misconduct, which was so serious that dismissal would be justified.

The Chair and panel members having considered all of the evidence made the following findings:

That the facts of Allegation 1 as admitted by PS Brown did not amount to a breach of the standards and did not amount to Misconduct or Gross Misconduct.

The panel found that PS Brown breached the standards of professional behaviour in relation to Authority, Respect and Courtesy and Discreditable Conduct in respect of Allegations 2, 3 and 4 and that his conduct amounted to Misconduct only. The panel found that his conduct did not breach the standards in respect of Equality and Diversity.

The panel imposed a Final Written Warning.
